Applications For Merit Review To Administrative Appeals Tribunal

If your visa application is refused by the Department of Home Affairs, it may be possible to appeal that decision to the Administrative Appeals Tribunal (AAT). The AAT can consider a wide range of visa related decisions, including refusals and cancellations. Our team of lawyers and immigration specialists have significant experience with a track record of success assisting clients appealing to the AAT.

Appeal To Federal Circuit Court

If your application to the AAT was unsuccessful, you may appeal to the Federal Court on a question of law.

Questions of law might include:

  • whether the AAT denied you procedural fairness; or
  • whether the AAT incorrectly interpreted a statute relevant to the proceeding.

For an appeal from a decision of the AAT to succeed, you must convince the Judge hearing the appeal that the AAT made an error of law and that the error contributed to the decision that is being appealed.
